What You Need to Know About Child Custody

If parents are not in good terms and they have a contested divorce, the court will decide on which parent has legal and physical custody of the child.

There are two types of Custody:

Legal Custody, this gives the parent legal rights to decide on decision making involving the child. These include school, home, activities, childcare and more. However, a court can order both parents joint legal custody or shared parental responsibility of the child.

Physical Custody, The court will decide on which parent has residential responsibility of the child. Just like legal custody, Physical custody can be awarded to both parents one parent. Both parents can agree on the schedule for the child, also known as time-sharing.

If both parents do not agree on the custody agreement, then the court decides on which parent, or both, should have legal and physical custody of the child. The Court looks at a variety of factors in making this determination. It is strongly encouraged to consult your family lawyer for guidance in your child custody case.
