In the State of Florida, a father's name on a birth certificate does not establish the child's paternity, but it can be used in a legal paternity action.

An unmarried biological father does not have a right to time sharing unless he files a paternity action, EVEN if he is paying child support.

Paternity of the child can be established through an agreement that is signed by both parents, or by a court order such as after a DNA test is performed.

Administrative hearing: The parents or other parties appear in court before a support magistrate. If there is a dispute over paternity, the court orders the mother, possible father and children to take blood or DNA tests.

If it becomes necessary to seek child support, a finding of paternity creates the basis for the obligation to provide support.

A support order cannot be established for a child who is born to unmarried parents until paternity has been established. It is important to establish paternity as early as possible.
