What You Need to Know About Child Custody

If parents are not in good terms and they have a contested divorce, the court will decide on which parent has legal and physical custody of the child.

There are two types of Custody:

Legal Custody, this gives the parent legal rights to decide on things involving the child. These include, school, home, activities, childcare and more. However, a court can award both parents to be legal guardians, also known as joint legal custody.

Physical Custody, The court will decide on where the child will stay physically, also called as residential parent. Just like legal custody, Physical custody can be awarded to both parents or also known as the joint physical custody. Where the child leaves or stay and how many days will be split equally. Both parents should agree on the schedule of a joint physical custody.

If both parents do not agree on the custody agreement, then the court will have to decide on which parent deserves to have both legal and physical custody of the child. It is strongly encouraged to consult your family lawyer for guidance in your child custody case.
